Consumer Terms
These Consumer Terms (“Terms”) govern your personal use of Mogic (“App”), owned and operated by Mogic Labs Inc. (“Mogic”, “we”, “us”). By downloading or using the App, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 16 years old or the age of digital consent in your jurisdiction to create an account. By registering, you represent that the information you provide is accurate and that you will keep it up to date.
You are responsible for maintaining the confidentiality of your credentials and any activity occurring under your account. Notify Mogic immediately if you become aware of unauthorized access.
2. License to Use
Mogic grants you a personal, limited, non-transferable, non-exclusive, revocable license to install and use the App on devices you own or control for personal, non-commercial purposes, subject to these Terms.
Except where expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit the App or its content.
3. Acceptable Conduct
- Use the App only for lawful purposes and in compliance with our Usage Policy.
- Refrain from sharing malware, spam, or content that infringes third-party rights.
- Respect the privacy of other users and do not attempt to access data you are not authorized to view.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription & Payment
Certain features of Mogic may require a subscription or in-app purchase. Prices and billing terms will be presented before you complete a transaction.
Unless stated otherwise, subscriptions renew automatically until cancelled. You can manage or cancel subscriptions via your App Store account settings. Payments are processed by Apple, and Mogic does not store your payment information.
5. Intellectual Property
All content, trademarks, logos, and intellectual property related to Mogic are owned by Mogic Labs Inc. or its licensors. Nothing in these Terms grants you ownership rights in the App or its content.
By submitting feedback or suggestions, you grant Mogic a worldwide, royalty-free license to use and incorporate your feedback without obligation.
6. Disclaimers
The App is provided “as is” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mogic does not guarantee uninterrupted or error-free operation.
Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.
7. Limitation of Liability
To the maximum extent permitted by law, Mogic and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill arising from your use of the App.
Mogic’s aggregate liability for any claims relating to the App shall not exceed the amount you paid, if any, for accessing the App in the twelve months preceding the event giving rise to the claim.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, USA, excluding its conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts located in San Francisco County, California, unless local law mandates otherwise.
9. Changes to These Terms
We may update these Terms to reflect operational, legal, or regulatory changes. If we make material changes, we will notify you via the App or email. Continued use after the effective date constitutes acceptance of the updated terms.
